1. This letter serves to inform you that you have been appointed as a Personal Driver / Special Driver under the headquarters of UPK Services, effective from the date of this letter. You have been appointed as a representative of the company to carry out tasks and duties related to the contract of a Personal Driver and Special Tasks.

2. Your appointment is subject to the terms and conditions set by the company, as well as those stipulated in the contract with the customer. You are also required to comply with any additional instructions issued during the period of service as determined by the company. Further details regarding the terms of service and payment, along with other conditions, are attached to this appointment letter.
We greatly appreciate your cooperation and attention.
a) The appointment is for a duration of one (1) year, starting from the date stipulated in the agreement with the client.
b) All agreements and client payments must be made under the name UPK Services to the following Maybank account number: 5627 9550 7767. The monthly invoice for the client must include the following details:

The monthly fee is RM 3,800.00, which includes consultation fees (excluding SST, overtime, allowances, and bonuses). The invoice will be issued on the 31st of each month, and payment must be cleared by or before the 7th of the following month.
c) An advance payment of RM 3,800.00 is required before the driver is permitted to begin work. The assignment period is as follows:
- Start Date: 01 October 2024
- End Date: 30 September 2025
d) The appointee agrees to:
- Follow all instructions and comply with the terms set forth by UPK Services.
- Uphold the highest standards of integrity, discipline, and care when performing assigned duties. This includes ensuring professionalism in driving, client services, and protection-related tasks.
e) Any instructions or information provided by the company must remain confidential. The appointee must refrain from sharing or disclosing any sensitive information related to the company or its clients to unauthorized individuals or parties.
f) The appointee agrees to:
- Complete assignments within Kuala Lumpur and nationwide as required.
- Complete any forms related to permit applications, as provided by the company. If necessary, permission to access secure areas will be requested using the appointee's personal details.
We appreciate your compliance with these terms and look forward to your cooperation.
g) All personal information provided in the application form, along with the attached documents, must be accurate and truthful. If any information is found to be false or violates any provisions under the Internal Security Act or any of the mentioned regulations, this approval will be immediately revoked, and legal action will be taken.
h) Prior approval must be obtained before creating any printed materials, electronic media promotions, or any related content.
i) Any refusal to comply with or breach of the stated terms will authorize the company to take legal action and immediately terminate your appointment. Furthermore, all company-owned equipment and resources must be returned to the company without delay.

a) If required, you will need to open a bank account at Maybank Berhad, Sungai Buloh Branch. The UPK Services Headquarters in Selangor will issue an official letter to Maybank Berhad, Sungai Buloh Branch, to verify that you are an employee of UPK Services.
b) You are required to provide the newly opened bank account details to UPK Services for the purpose of salary payments.
c) All salary, allowances, and any other payments will be credited to your bank account on or between the 1st to 5th of every month. Additional payments for overtime (OT) will be credited to your bank account on or before the 15th of the respective month.
a) Your duty location will be based on the requirements of UPK Services' clients. However, before the contract is signed by the client, you will be placed on a probation period of 1 to 6 working days. This period is for the evaluation of your suitability for the client and the role. (Daily salary during this period will be calculated at RM 120.00 for 8 hours of duty as a short-term assignment rate.)
b) Your duties will be in accordance with the work schedule set by the client, whether for day or night shifts, based on the designated 9-hour timeframe as required by the client.
c) You are required to perform the tasks assigned by the company as directed by the Chief Operating Officer, Manager, Operations Manager, or any higher authority within UPK Services.
a) You must undergo a medical examination with a doctor of your choice within one month of starting your service (applicable only to bodyguards). The cost of the medical examination is your responsibility.
b) If you fail to submit the medical report (applicable only to bodyguards) within one month, the company reserves the right to assign a company-appointed doctor to conduct the examination. The cost of this medical examination will also be borne by you.
c) You will be covered under the following contributions and deductions:
- EPF (Employees Provident Fund): As mandated by law.
- 13% Meal Deduction (Employer): Paid by the employer.
- 11% Employee Deduction: As per government-mandated rates.
- SOCSO (Social Security Contributions): In accordance with the statutory rate.
d) You are required to contribute to EIS (Employment Insurance System) as mandated by law.
a) It is acknowledged that any employee required to work beyond the standard 8-hour shift will be considered as working overtime. The overtime costs will be borne by the client and paid to you through UPK Services for the extra hours worked.
b) Overtime will be calculated from the 1st to the 15th of the month for the initial period and the subsequent months to simplify the submission of invoices.
c) If the client requires the employee to work on their designated off day, the client is obligated to pay double the overtime rate (Double OT). Refer to clauses 8.E.III and IV for further details.
d) On Public Holidays, if the client requires the employee to work during the holiday, the client must pay triple the overtime rate (Triple OT). Refer to clauses 8.E.V and VI for details.
e) The overtime rates are as follows:

f) The UPK-Claim OT-003 form and the attendance card will be used to process claims and calculate the overtime payment for the respective period.
a) Medical treatment is limited to 14 visits per year and can only be conducted at a clinic of your choice or a clinic designated by the client.
b) Medical treatments must be conducted at the clinics selected by you or those on the client’s panel. The cost of medical treatment will be covered by the client, with an annual limit of RM 400.00 (a maximum of RM 60.00 per month for each visit). Any excess beyond the limit will be your responsibility.
a) Your entitlement to annual leave is 12 days per year (calculated as an average of one day per month).
b) Public holidays are subject to the regulations of the state in which you are assigned. The client may also suggest additional leave days, depending on eligibility as per Malaysian government regulations.
As stipulated under Section 60F of the Employment Act 1955 (Act 265), the following applies:
a) A total of 14 days per calendar year if the employee has been employed for less than 2 years.
b) A total of 18 days per calendar year if the employee has been employed for 2 or more years but less than 5 years.
c) A total of 22 days per calendar year if the employee has been employed for 5 years or more.
The employer may terminate your services for specific reasons that compel either party to take such action by providing 14 days' written notice.
The employer may terminate your services, or you may resign from your position, by providing 24 hours’ notice and compensating one month’s salary in lieu of notice.
Your services may be immediately terminated under the following circumstances:
a) If you suffer from a medical condition that could endanger others or negatively impact the company’s operations.
b) If you damage the company’s reputation through behaviors that are detrimental to health or by being directly or indirectly involved in activities that contravene national laws.
c) If you are recorded with a criminal offense in the Royal Malaysian Police record or commit any criminal act during your tenure with the company.
d) If you are involved in the abuse or distribution of drugs, your services may be terminated immediately.
Your services will also be terminated under the following circumstances:
a) If the company shuts down.
b) If the location where you are assigned is closed, and your services are no longer required.
c) If the client no longer requires your services at the designated location.
d) If the branch where you are serving is closed for specific reasons.
e) If you receive three (3) warning letters regarding your performance issues, or if the client requests to replace you with another employee.
a) Upon reaching the age of 62 years, you will retire from active service with the company.
b) If the company wishes to extend your service, after considering your mental and physical health as well as your excellent performance, you may continue serving on a year-to-year basis.
c) To meet the eligibility requirements, you will need to undergo a medical examination at your own expense to verify your health status and confirm your fitness for continued service.
a) You are required to sign the acknowledgment of your appointment and submit a copy of the signed appointment letter to the UPK Services Headquarters. This must be done within one week from the date of this letter.
b) If you fail to do so, this appointment letter will automatically be void. However, if you have already signed the appointment letter, it will remain temporarily valid unless revoked independently.
a) As stipulated under the Employment Act 1955 (Act 265).
b) Comply with the laws of the Malaysian Government.
c) Adhere to road traffic and safety laws in Malaysia.
d) Compliance with Covid-19 SOPs is the sole responsibility of the client. Should there be violations or penalties related to these regulations that involve the employee and result from the client's actions, the client will bear full responsibility for such penalties.
a) The appointment letter will only take effect upon being signed by the Manager/Supervisor and the Client. However, the probation period of 1–6 days may still apply, depending on the matters outlined in the contract.
b) The terms of the appointment letter may be reviewed, revised, or updated at any time, as deemed necessary, with prior agreement from both parties.
a) As directed by the Ministry of Home Affairs (KDN), all personnel who are eligible for promotion as Security Officers/Bodyguards of Elite Guards are required to attend security-related courses such as the Certified Security Guard (CSG) and Personal Security Skills (CBG) courses. Additional courses recognized by the government and HRDF may also be required.
The expenses for attending these courses will be fully borne by the client, the company, or split equally between you and the company.
a) Accommodation will be fully provided by the client in cases where the employee is assigned outside of the state or during an outstation duty abroad. This includes travel expenses (to and from the location) and meals, if necessary.
a) In cases where a substitute is required, whether due to annual leave or absence, UPK Services will make efforts to find a replacement. The short-term assignment rate for 8 hours is set at RM 250.00, with an overtime rate of RM 20.00 per hour for additional work. These costs will be borne by the client.
a) As a client-focused policy, providing loans or advances to Special Drivers is highly discouraged. Special Drivers are required to directly communicate with the UPK Services Accounts Department for any matters related to loans or advances.
